1. Purpose and scope
This Acceptable Use Policy sets out the businesses and activities for which OmniWallet (the “Service”) may not be used, and the businesses that require the prior written approval of the OmniWallet operator (“we”, “us”). The operator’s full legal name and registered address will be specified here before this policy takes effect.
This policy forms part of our Terms of Service and applies to every merchant, its Authorized Users and sub-account users, and to every channel: the API, hosted invoices, payment links, donation pages, POS and embedded buttons and widgets. It applies in addition to the law: anything that is illegal where you, your customers or we operate is prohibited even if it is not listed below. Capitalized terms have the meanings given in the Terms.
2. Prohibited businesses
You may not use the Service for, or to receive payments connected with, any of the following:
- illegal goods or services;
- narcotics, controlled substances and drug paraphernalia;
- prescription drugs sold without a valid prescription;
- weapons, ammunition, explosives and their key components;
- gambling without the licenses required by applicable law;
- child sexual abuse material, and sexual or intimate content created or shared without the consent of the people depicted;
- human trafficking, forced labor, or the sexual or other exploitation of any person;
- counterfeit goods, and goods or services that infringe intellectual property rights;
- fraud, scams and other deceptive practices, including pyramid and Ponzi schemes and high-yield investment programs (HYIPs);
- financial services provided without required licenses, including money transmission, currency or crypto exchange and OTC trading, offerings of securities or tokens, and investment schemes;
- mixers, tumblers and other services designed to anonymize transactions or obscure the source of funds;
- sanctions evasion, or dealings with sanctioned persons, entities or jurisdictions;
- terrorism or terrorist financing;
- hacking tools, malware, ransomware, stolen data or credentials, and carding; and
- fake or forged documents or identities, including services for bypassing identity verification.
Zero tolerance: we will immediately terminate any account involved with child sexual abuse material and report it to the competent authorities, as required or permitted by law.
This list is not exhaustive. We may treat any business as prohibited if we reasonably consider that it presents an unacceptable legal, financial-crime or reputational risk.
3. Restricted businesses
The following businesses may use the Service only with our prior written approval, which we may give subject to conditions, or refuse:
- gambling, betting and lotteries operated under a valid license;
- legal adult content and services, with appropriate age verification;
- cryptocurrency exchanges and OTC desks;
- other financial services, such as payment, lending or investment services;
- nutraceuticals and dietary supplements;
- high-risk subscription models, such as free trials that convert into paid subscriptions;
- dating services; and
- travel services, such as travel agencies and ticketing.
To apply, contact support@ewin888.com. We may require evidence of your licenses and of your own compliance controls, apply enhanced due diligence, monitoring and limits, and withdraw our approval if the conditions are no longer met. Our approval does not mean that we have confirmed that your business is lawful; that remains your responsibility.
4. Prohibited use of the platform and API
Whatever your business, you must not:
- abuse or overload the Service, exceed rate limits or other technical limits, or interfere with other users;
- circumvent our limits, controls or screening, including by routing funds through intermediaries to avoid detection;
- split or structure Payments or Payouts to avoid thresholds, limits or reporting;
- probe, scan or test the security of the Service without our written authorization (responsible disclosure of vulnerabilities to support@ewin888.com is welcome);
- access accounts, data or systems that are not yours;
- resell, sublicense or white-label the Service, or process payments on behalf of other businesses, without our written agreement (other than through sub-accounts used in accordance with the Terms);
- impersonate us or any other person, or misrepresent your relationship with us;
- send spam, or use hosted invoices, payment links or donation pages for phishing or other deceptive messages; or
- give us false or misleading information, or use the Test Environment for real commercial transactions.
5. Enforcement
If we suspect a breach of this policy, we may investigate and ask you for information. Depending on the severity of the breach, we may:
- hold or freeze funds, hold or reject Payments, settlements or Payouts, or mark Payments as
failed; - restrict features, or suspend or terminate your account and the Terms; and
- report the matter to, and cooperate with, competent authorities where required or permitted by law.
Where the law permits, we will tell you about the action we take. Funds are released only after we complete our review and only to the extent the law allows. You are liable for any loss we suffer because of your breach. If you believe we have acted in error, contact support@ewin888.com.
6. Reporting violations
If you believe a merchant is using the Service in breach of this policy (for example, for a scam or to sell prohibited goods), or you have found a security vulnerability, contact support@ewin888.com. Please include relevant details, such as the payment ID, transaction hash, address or website.
We review every report but may not be able to tell you the outcome. We do not arbitrate disputes between merchants and their customers; payers with a complaint about a purchase should contact the merchant first.
7. Changes to this policy
We may update this policy, for example to reflect changes in law or in risks. The “Last updated” date shows the latest version. We will notify merchants of material changes in advance where practicable; changes needed for legal or compliance reasons may take effect immediately.
